PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari, calling for the records relating to the impugned order of the 3rd respondent in Na.Ka.No.9734/2017/A5 dated 15.11.2017 quash the same. ORDER
Read this order in conjunction with order dated 17.11.2021. A memo of compliance has been filed as follows: " MEMO FILED BY THE RESPONDENTS
1. It is respectfully submitted that by order dated 17.11.2021 passed in the above writ petition, this Hon'ble Court ordered that action against the erring officials as per the rules and regulations, in due compliance, the respondents have found the details of the erring officials who were working during the time of wrongful disbursement made in favour of the writ petitioner. Accordingly this respondent have identified 13 number of officials and this respondent has issued show cause notice dated 11.01.2022 vide proceedings No.RC M3/266/2022-4. 1/3
Out of the 13 officials, the show cause notice was served on 5 officials namely (1)R.Ravichandran (2) S.Ayyappan (3) S.Selvaraj (4) Prabhaharan (5) P.Selvaraj. Further, it is submitted that other officials namely (1) Muthukrishnan and Gunasekharan passed away. In so far as the remaining 6 officials, the notices are yet to be served because the details of those officials are not available with this office at present. This office is collecting the details of those six officials and as soon as the same is furnished to this respondent office, the show cause notices will be duly issued and necessary action would be taken in this regard in compliance with the orders of this Hon'ble Court.
2. It is further respectfully submitted that details in this regard furnished by this office along with a copy of the show cause notice are enclosed with this memo.
It is further respectfully submitted that this Hon'ble Court may be pleased to record the above submissions and pass suitable orders."
2.The proceedings initiated vide show cause notice dated 11.01.2022 will be concluded within a period of eight weeks from today and a report of compliance will be filed. Parallely, the remaining officials, who are all officials of TASMAC admittedly, will also be proceeded with and a composite memo of compliance will be filed within eight weeks from today. This Writ Petition is closed. No costs. Consequently, connected Miscellaneous Petition is closed.
