PRAYER :-For Bail in Crime No.28 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested on 06.06.2022 for the alleged offences under Sections 376, 417 & 506(i) of IPC, in Crime No.28 of 2022, on the file of the respondent police, seeks bail.

2.The learned counsel for the petitioner submitted that this is the third bail petition. Earlier bail petition filed by the petitioner in Crl.OP(MD)No.14141 of 2022 was dismissed by this Court dated 05.08.2022. The petitioner is in judicial custody from 06.06.2022. More than 90 days, he is in custody and hence, he seeks statutory bail to the petitioner under Section 167(2) Cr.P.C. 3.The learned Additional Public Prosecutor would submit that medical report is awaited. Even though, medical examination is over. 4.Considering the facts and circumstances of the case and also considering the fact that the petitioner is inside the prison for https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.15612 of 2022 the past 90 days, this Court is inclined to grant statutory bail to the petitioner with stringent conditions.

5.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, Madurai District, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 08/09/2022 / TRUE COPY / 08/09/2022 Sub-Assistant Registrar (C.S.)
