O R D E R
[Order of the Court was made by K.KALYANASUNDARAM, J.] The petitioner has filed this habeas corpus petition seeking direction to the respondents to produce his daughter, namely, Jebila, aged about 19 years, before this Court and set her at liberty.
2. The petitioner would state that the detenue is his daughter and she was studying first year in a College at Thoothukudi. On 14.12.2020, at about 08.00 a.m., she went to College, but she did not return to the house and hence, he lodged a complaint with the second respondent Police and the same was registered in Crime No.600 of 2020 under "Woman Missing". It is alleged that the second respondent Police has not taken any effective steps to secure the detenue after registration of the case hence, he gave a representation to the first respondent on 16.12.2020 and thereafter, he has filed this habeas corpus petition.
3. Today, when the matter is taken up for hearing, the detenue along with one Pankaj Kumar appeared before this Court https://hcservices.ecourts.gov.in/hcservices/ ___________
H.C.P.(MD) No.1218 of 2020 through Video Conferencing from the Office of the Public Prosecutor. On enquiry, the detenue would state that she is a major and she married one Pankaj Kumar on 08.01.2021 in Mangalore and she wants to go with her husband Pankaj Kumar. The father of the detenue / petitioner herein, who also appeared before this Court, would state that if the detenue wishes to go with her husband, he will not stand in her way.
4. In the light of the above statement of the detenue as well as her father, the detenue is set at liberty and the habeas corpus petition is ordered accordingly.
