Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the termination notice in Letter No. 3143/FH/2016 dated 30.4.2022 issued by the first respondent and quash the same and consequently forbear the respondents from evicting the petitioner from the premises of Hotel Tamil Nadu, Sattur except under due process of law.

ORDER
The present writ petition has been filed challenging the termination notice issued by the first respondent on 30.04.2022, terminating the lease granted to the writ petitioner to run Hotel Tamilnadu at Sattur. 2.A perusal of the lease agreement reveals that it is for a period of six years from 28.07.2016. Therefore, the question of adjudicating the termination notice as on today does not arise. 2/6
3.It is the grievance of the writ petitioner that though the first respondent had initially waived the rent for the lockdown period between 24.03.2020 to 31.08.2020, the same is not reflected in the impugned order. He further submitted that he is ready to pay the rental arrears, provided the penal interest is waived by the first respondent corporation. 4.The learned counsel appearing for the respondents 1, 3 and 4 submitted that the penal interest was levied only as per Clause 8 and 10 of the agreement entered into between the petitioner and the corporation on 28.07.2016 and, therefore, the petitioner cannot have any grievance with regard to the levy of penal interest for the delayed remittance of rental arrears. He further submitted that when the petitioner deposits the entire rental arrears, the waiver granted for the lockdown period has already been taken into account.
5.Heard both sides and perused the entire materials on record. 6.As far as the termination notice issued by the first respondent is concerned, the lease period has already expired and nothing survives for 3/6
adjudication. As far as the waiver of the lease rent for the lockdown period from 24.03.2020 to 31.08.2020 is concerned, the respondent corporation is bound to waive the lease rent for the above said period and the same does not depend upon any request. The penal interest imposed upon the writ petitioner is based on the agreement entered into between the parties and, therefore, the same cannot be interfered with in the present writ petition.
7.Considering the above facts, the first respondent corporation is directed to issue a fresh notice to the writ petitioner, calling upon him to pay the arrears after waiving the rental arrears for the lockdown period. 8.With the aforesaid observations, this Writ Petition is disposed of.
