JUDGMENT

(Judgment of the Court was made by G.R.SWAMINATHAN, J.) This appeal is directed against the order dated 30.04.2025 dismissing W.P.(MD)No.20553 of 2016 filed by the appellant herein.

2. The learned counsel for the appellant realizes the fallacy of his action; he ought to have availed the appeal remedy. He instead chose to move the writ Court in the first instance itself. 2/4

3. The learned counsel for the appellant states that the appellant seeks leave to withdraw the writ petition and avail appeal remedy. Leave is granted. W.P.(MD)No.20553 of 2016 is allowed to be dismissed as withdrawn. The order dated 30.04.2025 is set aside. The appellant is given liberty to file an appeal before the appellate authority. If the appeal is filed within four weeks, it shall be numbered without reference to limitation and dealt with on merits and in accordance with law.
