Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for records pertaining to letter dated 13.06.2025 in reference No.OBJ/1049340560/2025 and quash it as illegal and subsequently direct the first respodent to renew the passport bearing No.N5176664 based on the petitioner's application reference No.25-1053363407, dated 09.06.2025 within the time as fixed by this Court.

ORDER
This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Central Government Standing Counsel appearing on behalf of the first respondent and the learned Government Advocate appearing on behalf of the second respondent.

The petitioner has been arrayed as accused No.1 in FIR registered in Crime No.1317 of 2020, dated 29.09.2020 on the file of the second respondent Police Station for the offences punishable under sections 21(1) of MMDR Act, 3(1) of Prevention of Damage to Public Property Act, 1984 and 430, 379 of IPC. Another First Information Report has been filed against the petitioner in Crime No.6 of 2020 for the offences punishable under Sections 294(b), 324 and 506(ii) of IPC.

3. It is confirmed by the learned counsel for the second respondent that no charge sheet has been filed against the petitioner pursuant to the FIR registered in Crime No.1317 of 2020 and in Crime No.6 of 2020.
4. The learned counsel for the first respondent on the other hand has raised his objection in view of the First Information Reports registered against the petitioner in Crime No.1317 and 6 of 2020 for the above offences.
5. Since no criminal case is pending against the petitioner as on date pursuant to the FIR registered in Crime No.1317 and 6 of 2020, there can be no impediment for renewing the passport of the petitioner.
6. Under these circumstances, there shall be a direction to the first respondent to renew the passport of the petitioner as expeditiously as possible. In case, charge sheet is filed by the second respondent before the concerned Court pursuant to the aforesaid Crime Nos.1317 and 6 of 2020 registered against the petitioner, the petitioner shall surrender the passport before the concerned Court. In case the petitioner proposes to travel abroad, the petitioner may file a suitable application before concerned Court to retrieve the same. 3/5
7. With the above direction and liberty, this Writ Petition is disposed of. No costs.
