Heard the learned counsel on either side.

2. The petitioner seeks separate electricity connection for the petition mentioned first floor.

3. The learned Standing counsel states that the petitioner can apply under the DCW scheme and this is because the electric pole is located very close to the building.

4. I fail to understand the stand taken by the TANGEDCO. The ground floor of the petition mentioned building is already enjoying service connection. Therefore, there cannot be any objection for granting separate electricity connection for the first floor also. If according to TANGEDCO, the location of the pole is not safe, it is for them to take action for shifting the same. The petitioner cannot be made to bear the cost of such shifting. When the ground floor is having the electricity connection, there is no justification in denying the service connection to the first floor of the very same building. 2/4

5. The second respondent is directed to provide service connection for the first floor of the petitioner's house as expeditiously as possible. This writ petition stands allowed. No costs.
