JUDGMENT

This present Appeal Suit is preferred by the plaintiff against the Judgment and Decree passed in O.S. No.7 of 2011 on the file of the III Additional District and Sessions Court, Tirunelveli, dated 21.10.2013.

2. The suit in O.S. No.7 of 2011 for specific performance and the suit was dismissed. Against the same, the plaintiff has filed the Appeal suit. 1/4

3. Pending this appeal, both the parties have settled their issue amicably. The defendants 1 & 2 have executed a Power of attorney, dated 12.11.2015. The Power holder had sold the property to the plaintiff, vide document dated 09.02.2018. Therefore, nothing survives for adjudication. The sale deed, dated 09.02.2018 is recorded and the same shall form part of the decree.

4. Accordingly, this Appeal Suit stands disposed in the light of the amicable settlement among the parties. No Costs. 10.07.2024 Index : Yes / No NCC : Yes / No KSA 2/4
