Respondent Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned Refudal Check Slip in RFL/Adirampattinam/41/2026 dated 19.05.2026 quash the same and consequently direct the respondent herein to register the Receipt/Deed of Discharge dated 19.05.2026 presented by the petitioner. ORDER

The writ petition has been filed challenging the impugned refusal check slip dated 19.05.2026.

2. When the petitioner presented the title deed for the loan, the same was refused on the ground that the original parent document relied upon in the title deed had not been produced.

3.The learned counsel appearing on behalf of the petitioner submitted that, by the judgment dated 23.06.2026 in Dugars v. State of Tamil Nadu (W.P. (MD) Nos. 7415 of 2026), the Division Bench of this Court had declared the said provision to be unconstitutional.

4. In view thereof, the legal position prevailing prayer to the enactment of section 31-C will come into operation as per the law laid down by this Court. It is enough, if a certified copy of the parent deed is also produced.

5. In view thereof this writ petition is ordered on the following terms:- (I) The impugned refusal check slip dated 19.05.2026 is set aside. 2/4

(ii) The petitioner shall represent the document along with the certified copy of the parent deed that is relied upon in the document and upon such representation, the document shall be registered, if there is no other impediment.
