Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent herein to consider the petitioner's representation, dated 21.09.2020, requesting the 1st respondent herein to conduct a detailed enquiry and cancel the patta standing in the name 3rd respondent and to restore the same in the name of the petitioner in Patta No.1172 in respect of the property bearing S.No.236/6, measuring 1.34.0 Hectares, situated at Vengaloor Village, Devakottai Taluk, Sivagangai District.

ORDER

The petitioner herein seeks a direction to the first respondent to consider her representation, dated 21.09.2020, seeking review of the order passed by the first respondent in his proceedings Pa.Mu.B42/2212/14il, dated 06.10.2015.

It is the case of the petitioner that the property with an extent of 1.34 Hc. in Survey No.236/6 in Vengaloor Village, Devakottai Taluk, Sivagangai District, was settled by the petitioner's father under a registered settlement deed, dated 24.04.2006, and patta for the subject property was issued in the name of the petitioner in Patta No.1172. Later, it came to the knowledge of the petitioner that patta was issued in the name of the third respondent by the first respondent in his proceedings, dated 06.10.2015, without notice to the petitioner. Therefore, an instant representation was submitted by the petitioner on 21.09.2020, seeking review of the order passed by the first respondent, granting patta in favour of the third respondent.

3. The first respondent has no power of review. Therefore, the representation submitted by the petitioner, seeking review of the order, cannot be considered. However, it is open to the petitioner to challenge the patta transfer order, dated 06.10.2015, passed by the first respondent, in the manner known to law.

4. With the above liberty, the Writ Petition stands disposed of. No costs.
