The Civil Miscellaneous Appeal is preferred by the appellant against the order of remand made by the judgement and decree dated 28.02.2014 made in A.S.No.51 of 2013 on the file of the Subordinate Judge, Pudukottai, reversing the judgement and decree dated 31.01.2012 made in O.S.No.43 of 2005 on the file of the District Munsif cum Judicial Magistrate, Thirumayam.

2. The learned Counsel for the appellant prays time to take steps for respondent who died during the pendency of the Civil Miscellaneous Appeal. But on perusal of records, this Court finds that the sole respondent died on 04.07.2017, till date no steps have been taken to bring the legal representatives of the deceased sole respondent. Therefore, this Civil Miscellaneous Appeal is dismissed as abated. No costs.
