PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.104 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/A.1, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 394 IPC, in Crime No.104 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused assaulted the defacto complainant by using stick and sickle and snatched gold jewels worth about Rs.40,000/- and cash of Rs.4,000/- from him. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that property is not yet recovered.

5. Considering the seriousness and gravity of the offence alleged and also the facts that property is not yet recovered and that the petitioner is having two previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
