ORDER

[Order of the Court was made by D.KRISHNAKUMAR, J.] Today, when the matter is taken up for hearing, the learned Standing Counsel appearing for the respondent Bank submitted that the co-borrowers passed away. Therefore, the respondent Bank is inclined to initiate SARFAESI proceedings afresh to recover the amount from the surviving legal heirs of the co-borrowers and the guarantors.

2.In view of the aforesaid submission, nothing survives for further adjudication in this matter. Therefore, this Writ Petition stands dismissed with liberty to the respondent Bank to initiate SARFAESI proceedings afresh in accordance with law. No costs. Consequently, connected miscellaneous petitions are closed.
