PRAYER :- For Bail in Crime No.227 of 2020 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioners/A1 and A2 herein were arrested and remanded to Judicial Custody on 03.12.2020 for the offences punishable under Sections 6(4) of TNSC (RDCS) Order 1982 r/w. Section 7(1)(a)(ii) of Essential Commodities Act,1955.
2. The case of the prosecution is that the petitioners were found in illegal possession of 38 bags of rice (each contains 50 kgs).
3. The learned counsel for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in the above case. He would also submit that the PDS rice was recovered.
4.The learned Government Advocate(Crl.Side) would submit that petitioners were found in illegal possession of 38 bags of PDS rice.
5. Taking note of the above facts and circumstances of the case and also taking note of the fact that rice was recovered and 1/3
also taking into consideration the period of incarceration, this Court is inclined to grant bail to the petitioners subject to the following conditions:
7.Accordingly, the petitioners are ordered to be released on bail, subject to the following conditions [a] the petitioners are directed to contribute 15 bags of branded ponni rice (each 50 Kg), to the Annai Asramam, Children Home, Vinoba Nagar, Trichy-7 without prejudice to their defence before the trial Court [b] On such contribution being made,the petitioners shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.VI, Tiruchirapalli, Trichy District.
[c] the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity;
[d] the petitioners shall report before the respondent police daily at 10.30 a.m until further orders.
[e]the petitioners shall not abscond either during investigation or trial.
[f]the petitioners shall not tamper with evidence or witness either during investigation or trial.
[g]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [h]If the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
