For Appellant : Mr.G.Thalaimutharasu For Respondent : Mr.R.Devaraj COMMON JUDGMENT These Civil Miscellaneous Appeals are directed against the final and decreetal order, passed in IDOP Nos.100 and 103 of 2010, dated 13.12.2013 on the file of the III Additional District Judge, Trichy.
2.It is represented by the learned counsel for the appellant and the learned counsel for the respondent that the dispute between the parties have been settled before the Tamil Nadu Mediation and Conclusion Centre, attached to this Bench, dated 01.03.2021 and to that effect, a Settlement Agreement was also entered into between the parties on 01.03.2021, which would run thus:- https://hcservices.ecourts.gov.in/hcservices/ (a)Both parties agreed to withdraw the
allegations and contentions made against each other before Trial Court and Appellate Court. (b)Respondent agreed to allow the CMA(MD) No.1094/2014 before this Hon'ble Court.
(c)The Respondent agreed to allow the CMA (MD)No.1169 of 2014 before this Hon'ble Court. (d)Both the parties that they have no other claims against each other in future.
3.Accordingly, the final and decreetal order, passed in IDOP Nos.100 and 103 of 2010, dated 13.12.2013 on the file of the III Additional District Judge, Trichy, are set aside. 4.Recording the above, these Civil Miscellaneous Appeals are disposed of, in terms of the settlement arrived at between the parties. The settlement agreement entered by the parties before the Mediation and Conciliation, attached to this Bench, dated 01.03.2021 shall form part of the order. No costs. Consequently connected Miscellaneous Petitions are closed.
