ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 341, 323, 324 and 506 1/3

(2) of IPC in Crime No.240 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity over a civil dispute, the petitioner along with his wife abused the defacto complainant, assaulted him. Hence the complaint.

3. The learned Government Advocate (Crl.side) would submit that petitioner was already granted anticipatory bail in Crl.O.P(MD)No.1432 of 2023 dated 25.01.2023. He could not comply the conditions. Since he was admitted in the hospital, he filed miscellaneous petitions seeking extension of time. That petition was allowed. Even after allowing the miscellaneous petition, the petitioner could not comply the condition. Hence, this second petition seeking anticipatory bail, was filed.

4. The second anticipatory bail petition, will not lie. If the petitioner is granted anticipatory bail, he must comply the conditions imposed therein properly.
