A Perusal of the earlier adjudication on 17.09.2025 would show that the sole respondent died as early as on 1.1.2018 and till date, the learned counsel for the appellant did not take any steps to bring the legal heirs of the deceased sole respondent on record. Today also the learned counsel for the appellant is not ready to argue the appeal and sought for adjournment. This shows that the learned counsel for the appellant is not interested in prosecuting the appeal diligently. Hence, this Court has no other option except to dismiss the appeal for non prosecution.

2.Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs.
