Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus directing the respondent to consider and dispose of the petitioner's representation, dated 03.12.2020, as expeditiously as possible more particularly prior to 30.12.2020, so as to enable the petitioner to get the petitioner's name included in the select list prepared in this regard.

This writ petition has been filed for a direction to the respondent to consider and dispose of the petitioner's representation, dated 03.12.2020, more particularly prior to 30.12.2020.

2. The learned counsel appearing for the petitioner submitted that the petitioner is working as the District Revenue Officer, Madurai and his name has been included in the Select List Prepared by the respondent for the District Revenue Officer for the year 2012. He further submitted that normally, the respondent used to publish the Select List prepared by him once in five years i.e. in the month of July and the respondent has published the last Select List in the year 2014. Therefore, the respondent has to publish the Select List in the year 2019 itself. However, the same has not been published so far.

He also submitted that the appointments are being governed by the provisions of the Indian Administrative Service (Appointment by Promotion) Regulation 1955, wherein Clause 5(3) makes it very clear that the Selection Committee shall not consider the cases of members of the State Civil Service, who have attained the age of 56 years on the first day of January of the year for which the Select List is prepared. Therefore, he has given a representation, dated 03.12.2020, to the respondent. But so far no https://hcservices.ecourts.gov.

W.P.(MD).No.19680 of 2020 order has been passed. Hence, the petitioner has approached this Court by filing this writ petition.

3. Mr.R.Rajaram, learned counsel takes notice for the respondent and submitted that appropriate direction may be issued to the respondent to consider the petitioner's representation and publish the Select List prepared by him.

4. Considering the above said submissions, this Court directs the respondent to publish the Select List prepared by him on or before 31.12.2020, by considering the petitioner's representation, dated 03.12.2020.
