For Appellant : Mr.S.Srinivasa Raghavan For R-2 : No Appearance JUDGEMENT The Insurance Company has preferred this Civil Miscellaneous Appeal to set aside the award, dated 24.04.2006, made in W.C.No.6 of 2005, on the file of 1/4
the Workmen's Compensation Commissioner and Deputy Commissioner of Labour, Dindigul.
2. It is a case of injury. The contention of the Insurance Company is that in the vehicle which was involved in the alleged accident only two persons are permitted to travel. However, at the time of the accident, in the said vehicle five persons were travelled.
3. It is seen in the said accident three persons were injured, but no claim petitions were filed by the other two injured persons. Therefore, this Court is not inclined to interfere with the order passed by the Tribunal and the Civil Miscellaneous Appeal is liable to be dismissed.
4. Accordingly, this Civil Miscellaneous Appeal stands dismissed. No Costs.
