This Criminal Original Petition has been filed to direct the 1/3

first respondent to withdraw the case in Crime No.213 of 2019 from the Respondent No.4 and transfer the case in Crime No.213 of 2019 on the file of the Respondent No.4 to Respondent No.3. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (criminal side) for the respondents 1 to 4.

3.The learned counsel appearing for the petitioner would submit that the deceased is the own brother of the petitioner and the deceased was working under Haaliq Alavudeen and he is the Proprietor of Ola Cabs with luxury cars such as BMW, Mecrcedes, Audi and he voluntarily added the deceased commit car into accident for claiming huge amount on insurance from the Insurance Company. Like wise on 04.06.2019, the deceased drove a car / BMW and hit as against the Wall and the deceased sustained grievous injuries and died. Immediately, the fourth respondent has registered a case in Crime No.213 of 2019 for the offences under Section 304(A) IPC against the petitioner. Therefore, the petitioner sent a representation to the respondent No.1 to 4 by postal receipt dated 10.08.2019 for appropriate action as against the accused person.

4.The learned Government Advocate (Crl. Side) appearing for the respondents 1 to 4 submitted that on the accident committed by the brother of the petitioner, a case has been registered in Crime No.213 of 2019 for the offence under Section 304(A) IPC. The driver of the car died and as such the entire charges framed against the deceased is abated.

5.Considering the submission made, the second respondent is directed to monitor the investigation to be conducted by the fourth respondent in Crime No.213 of 2019. Further, the fourth respondent is directed to complete the investigation and file a final report within a period of twelve weeks from the date of receipt of a copy of this order.

6.With the above direction, this criminal original petition is disposed of.
