PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of certiorarified mandamus calling for the records relating to the impugned order passed by the 3rd respondent dated 1/4

30.07.2022 and quash the same as illegal and further direct the respondents to sanction the subsistence allowance to the petitioner by considering his physical illness.

ORDER

The petitioner is an erstwhile employee of the 3rd respondent society. The petitioner with a grievance that he was not paid with subsistence allowance has submitted a representation to the third respondent and the same was rejected that this petitioner caused loss to the society, which is the subject matter of an enquiry and based on the outcome, the subsistence allowance, if any eligible, would be paid to the petitioner. As against this order of the 3rd respondent dated 30.07.2020, the petitioner has filed this writ petition.

2.When this writ petition is taken up for hearing, it is reported that this petitioner has passed away. It is also reported that the petitioner was dismissed from service after the completion of the disciplinary proceedings.

3.Considering the subsequent developments, this writ petition is closed with liberty to the legal heirs of this petitioner to claim the subsistence allowance, if any, due to be paid to the petitioner. No costs.
