COMMON PRAYER :- For Bail in Crime No.114 of 2023 on the file of the Respondent Police.

COMMON ORDER : The Court made the following order :- The petitioners/Accused herein, who was arrested on 16.05.2023 for the alleged offence under Sections 147, 148, 294(b), 324, 307, 427, 506(ii) IPC, in Crime 1/4

No.114 of 2023, on the file of the respondent police, seeks bail. 2.These are the second petitions for bail. The earlier petitions were dismissed by this Court on 14.07.2023. Since the investigation has been completed, final report is also made ready. The co-accused has already been granted bail by the lower Court. Also the petitioners are in custody from 16.05.2023, seeking bail, these petitions have been filed by the petitioners for the second time. 3.The learned Additional Public Prosecutor submitted that the final report is made ready on 20.07.2023, but not yet presented before the trial Court. However, considering the gravity of offence, prays to dismiss the petitions. 4.Considering the fact that the petitions filed for bail for the second time, that the final report is also made ready.

The third accused, who is standing on the same footing as that of the petitioners was enlarged on bail and also considering the period of incarceration undergone by the petitioners, this Court is inclined to grant bail to the petitioners with certain conditions. 5.Accordingly, this Criminal Original Petition is allowed on condition that the petitioners shall deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the credit of Cr.No.114 of 2023 before the trial Court concerned, without prejudice to their rights and contentions before the trial Court.

6.On such deposit being made, the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Cheranmahadevi, Tirunelveli, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders.
