P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari calling for the records culminated in impugned show cause notice in ref.Na.Ka.No.302/A1/2018 dated 02.03.2018 issued by the 4th respondent and quash the same as illegal. ORDER

This writ petition has been filed challenging the show cause notice issued by the fourth respondent dated 02.03.2018 thereby directed the petitioner to submit an explanation for the irregularities found during inspection in the petitioner's old age home.

2. Heard the learned counsel on either side and perused the materials placed before this Court.

The petitioner is running a home for destitutes at Mettur Gate, Nilakottai Taluk, Dindigul District, with the permission of Government of Tamil Nadu, for the period upto 07.04.2018, as per the order dated 08.04.2015 on the file of the Social Welfare Department. Thereafter, an inspection was conducted and there were some irregularities found in the home. Therefore, the petitioner was issued with a show cause notice dated 02.03.2018 by the fourth respondent, which is impugned in this writ petition.

4. On perusal of the records, it is seen that the petitioner obtained an order of interim stay by order of this Court dated 15.03.2018 passed in this writ petition and still he is running the old age home.

5. In view of the above, the fourth respondent is directed to conduct a fresh inspection in the petitioner's old age home and if any irregularities and discrepancies are found in the petitioner's old age home, the fourth respondent is at liberty to issue fresh show case notice and take appropriate action in accordance with law. 3/6

6. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 08.11.2024 Index : Yes / No NCC : Yes / No Sm 4/6
