ORDER

The petitioner seeking a writ of mandamus to direct the second respondent to survey and measure the metes and bounds of the petitioner's property at Survey No.199/19 at Mullakkadu Village, Thoothukudi Taluk, Thoothukudi District measuring 98 cents on the basis of his representation dated 17.01.2018, has filed this writ petition.

2.When this writ petition was taken up for hearing on 04.03.2024, there was no representation for the petitioner. Hence, this matter was directed to be listed today under the caption 'for dismissal'. Even today, there is no representation for the petitioner.

3.This writ petition is pending from the year 2018. Hence, this Court is inclined to dispose of this writ petition based on the available records. 4.The learned Additional Government Pleader appearing on behalf of the official respondents submits that the four boundaries mentioned in the documents produced by the petitioner along with the application seeking survey of the 2/4

petition mentioned property, is not available on the field and hence, the survey could not be conducted. Therefore, the application submitted by the petitioner was rejected on 03.09.2018 and the same was also communicated to the petitioner also.

4.Recording the submissions made by the learned Additional Government Pleader appearing for the official respondents, this writ petition is closed. The petitioner is at liberty to file an appeal under the provisions of the Survey and Boundaries Act against the order dated 03.09.2018.
