ORDER
The Petitioner has prayed for issuance of a Writ of Mandamus directing the respondents to expedite the enquiry in Na.Ka.Aa.No.
4/6741/2018 .
2.Mr.D.Sadiq Raja, learned Additional Government Pleader takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. 3.The case of the Petitioner is that the Petitioner's grand-mother Surumbayee owned an extent of 65 cents in S.No.319/2 in Marudur Village of Kulithalai Taluk, Karur District and the Petitioner is the legal heir of the said Sirumbayee. During UDR Scheme the patta standing in the name of Surumbayee Ammal was deleted and one Angammal has been shown as the owner of the above said property in the revenue records. Hence the Petitioner submitted a petition before the second respondent for correction of the same in the village records, who in-turn had issued a notice of enquiry to the Petitioner. The Petitioner had also appeared before the Tahsildar on 6.1.2022 and produced the title deeds and deposed before the enquiry officer.From that date onwards, there is no further progress in the enquiry. Hence the Petitioner has filed this Writ Petition for the relief stated supra.
4.In support of his claim, the learned counsel for Petitioner has filed the document of the year 1956. It is seen from the proceedings of the Tahsildar,Kulithalai, dated 20.11.2018 and 23.7.2019 and Petitioner's
representation, dated 5.7.2022 that after 6.1.2022, the enquiry was not proceeded further. The Petitioner would further submit that due to the pendency of the enquiry, he was put to mental agony and great hardship. 5.In view of the above submission, this Court, without going into the merits of the matter, directs the third respondent/The Tahsildar, Taluk Office, Kulithalai, Karur District to conduct the enquiry in Na.Ka.Aa.No. 4/6741/2018, dated 9.11.2018 and conclude the same,after affording an opportunity of hearing to the parties concerned, within a period of sixteen weeks from the date of receipt of a copy of this order. 6.With the above direction, the Writ Petition stands disposed of. No costs.
