PRAYER :- For Bail in Crime No. 359 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners/Accused No.1 & 4 herein, who was arrested on 29.062023 for the alleged offence under Sections 399 of IPC, in Crime No.359 of 2023, on the file of the respondent police, seek bail.
2.The case of the prosecution is that while the respondent police in their regular patrol near Ponnumandurai, Pudupatti Colony Graveyard, they found that the petitioner and other accused preparing for committing a dacoity. 1/3
3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and due to wreck vengeance, the petitioners have been falsely implicated in this case.
4.The learned Additional Public Prosecutor submitted that there is no previous case against the petitioners. The co-accused has been already granted bail by this Court.
5.Considering the period of incarceration and the fact that the co-accused has been released on bail by this Court and since the petitioner is having no previous cases, this Court is inclined to grant bail to the petitioners with stringent conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Dindigul and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
