O R D E R

This petition has been filed seeking to direct the respondents to permit the petitioner to withdraw eligible amount from and out of his PF accumulation available to the credit of his PF Account No. 10691 in terms of the quantum or limit prescribed under Rule 13(1)(d) of Tamil Nadu State Transport Corporation (Madurai) Limited Provident Fund Trust Rules within the time limit 2/6

fixed by this Court so as to enable him to meet out marriage expenses of his daughter which was held on 28.05.2026.

The learned counsel for the petitioner submitted that the petitioner had applied for withdrawal of a sum of Rs.5,00,000/- from the provident fund accumulation for the purpose of meeting the expenses of his daughter's marriage. It was further submitted that the total accumulation standing to the credit of the petitioner is Rs.13,56,986/-. The petitioner seeks withdrawal of Rs.5,00,000/- in terms of Rule 13(1)(d) of the Employees' Provident Fund Trust Rules, under which such withdrawal is permissible. Therefore, the claim made by the petitioner is as per rules.

The learned counsel further submitted that Rule 13(1)(d) prescribes that the amount of withdrawal shall not exceed six months' pay or the total accumulation of exempted contribution together with exempted interest standing to the credit of the employee, whichever is less. According to the petitioner, six months' pay works out to Rs.4,70,880/-, whereas the respondent has calculated 3/6

the same at Rs.4,22,000/- based on the petitioner's basic pay and dearness allowance multiplied by six months. The dispute, therefore, is confined only to the computation of six months' pay and not to the petitioner's entitlement to seek withdrawal under the Rules.

4. Heard the learned counsel appearing for the State/respondents.

5. This Court is only concerned with verifying the calculation. The calculation submitted by the respondents, showing the amount payable as Rs. 4,22,000/-, is accepted for the purpose of this proceeding. It is an admitted fact that the respondents have already paid a sum of Rs.2,00,000/- to the petitioner. Accordingly, the balance amount payable is Rs.2,22,000/-. If the petitioner is aggrieved by this calculation or claims any further amount, he is at liberty to seek appropriate adjudication in separate proceedings. Therefore, the respondents are directed to pay the balance sum of Rs.2,22,000/- to the petitioner within a period of three weeks from the date of receipt of a copy of this order. 4/6
