Heard the learned counsel appearing for the writ petitioner and the learned Government Advocate appearing for the official respondents.
2. Considering the nature of relief to be granted, issuance of notice to the private respondent is dispensed with.
3. The petitioner had been characterised as an encroacher and proceedings for evicting him were taken by the second respondent. The petitioner has availed the statutory remedy of appeal before the first respondent.
3. The first respondent is directed to dispose of the petition mentioned appeal on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
4. I make it clear that I have not gone into the merits of the matter. The first respondent shall put all the interested parties on notice before passing final order. It is open to the first respondent to pass order one way or the other. 2/4
