For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.11 of 2019 on the file of the respondent ORDER : The Court made the following order :- The petitioner is figuring as second accused in Crime No.11 of 2019 registered on the file of the respondent for the offences under Sections 417, 418, 420, 465 and 468 of IPC.
2.The case of the defacto complainant is that he transferred a sum of Rupees One crore to the accused as the accused had promised that they would raise loan of Rupees Fifty Crores at a low interest rate.
3.The first accused was granted anticipatory bail by this Court and he had returned a sum of Rs.50,00,000/- to the defacto complainant. This Court wanted to know from the petitioner's counsel, if the petitioner would be willing to return the balance amount of Rs.50,00,000/- to the defacto complainant. CRL OP(MD). No.12603 of 2019 4.The allegations are serious. This Court can take judicial note of the fact that such gangs are operating in the State of Tamilnadu. They get in touch with gullible business men who are in need of funds for expanding their business. These gangs make it appear that they are having high connections and they would be able to arrange huge loans at nominal interest rates. The gullible business men believe such words and part with certain sums of money as processing fee and commission charge hoping to get a huge loan amount later. After the processing fee charges and the commission amount are paid, the offenders simply vanish. This Court has come across several such instances in the recent past. 5.The learned Government Advocate (Crl.side) states that the similar complaints have been received against the petitioner in other police stations also.
