For Respondent : Mr.B. Thanga Aravindh Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.479 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under section 394 of I.P.C., in Crime No. 479 of 2021 on the file of the respondent police, seek/s anticipatory bail.
2. The case of the prosecution is that the defacto complainant is the son of the injured person and also victim. According to the defacto complainant, on 25.01.2021 at about 5.55 pm the victim was walking on the road and at that time, two persons came in a two wheeler and snatched the gold chain weighing about six sovereigns and in the above process she got injured. In the above said occurrence A1 has already been arrested and the petitioner herein as arrayed as A2.

3. The learned counsel appearing for the petitioner submitted that based on the confession of A1 only the petitioner herein was arrayed as accused and he is innocent and his name has been falsely implicated in this case.
4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the petitioner is not only involved in this case, but also involved in five previous cases. Based on the confession of co-accused the petitioner herein is arrayed as accused and the portion of the jewels only recovered and the investigation of the case is pending.
5. Considering the nature of serious offence committed by the petitioner and that he is having five previous cases and that the proper investigation of the case is necessary, he is not entitled for discretionary relief of anticipatory bail.
