PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.113 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners/A2, A4 & A5, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 296(b), 115(2) and 105 of BNS, 2023 r/w. Section 4 of TNPHW Act in Crime No.113 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the 1st accused and the de-facto complainant's daughter were in love and got married. With an intent to separate them, the de-facto complainant and her husband unnecessarily interfered in their matrimonial life and caused trouble. On 08.04.2025, at about 08.00 p.m., the 1st accused attacked the de-facto complainant's daughter. Upon knowing this, the defacto complainant and her husband rushed to the 1st accused's house, separated them, and brought her back with them. Thereafter, the accused unlawfully assembled, abused the de-facto complainant's husband using filthy language, attacked him by striking on his neck and pushed him to the ground. As a result, the de-facto complainant's husband died. Hence, a case has been registered.
3. The learned counsel appearing for the petitioners submitted that the 2/4
petitioners are innocent persons and have not committed any offence as alleged by the prosecution. He submitted that the deceased was an elderly person and had collapsed due to a cardiac arrest. He was immediately taken to the hospital, where the doctors declared him dead. He further submitted that A1 and A3 were arrested and subsequently released on bail by the learned Principal Sessions Judge, Dindigul, on 04.06.2025, in Crl.M.P.No.987 of 2025. He, however, submitted that the petitioners are ready and willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.

The learned Government Advocate (Criminal Side), by filing the status report, submitted that there are totally six accused persons in this case and the petitioners have been arrayed as A2, A4 and A5. A1 and A3 were arrested and subsequently released on bail by the learned Principal Sessions Judge, Dindigul, on 04.06.2025, in Crl.M.P.No.987 of 2025. He further submitted that the investigation in this case is still pending. Hence, he opposed to grant anticipatory bail to the petitioners.

Taking into consideration the facts and circumstances of the case, the gravity of the offence allegedly committed by the petitioners, and also taking note of the fact that the investigation in this case is still pending, this Court is not inclined to grant anticipatory bail to the petitioner at this stage. 3/4
