ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to call for the records in Crime No.107 of 2022 pending on the file of the first respondent and quash the same.

2. The learned Additional Public Prosecutor appearing for the first respondent would submit that two cases, a case and case in counter came to be registered in Crime Nos.107 of 2022 and 108 of 2022, that the first respondent, after completing the investigation, has filed the final report in Crime No.107 of 2022 and the same was taken on file in C.C.No.433 of 2022 on the file of the Judicial Magistrate, Perayur and that in case in counter, final report has not been filed. He would further submit that the complainant, who is the Executive Officer of T.Kallupatti Panchayat, in Crime No.108 of 2022, was not co-operating with the police for completing the investigation.

3. Whatever it is, admittedly, the first respondent has not followed the procedure meant for investigation in the case and case in counter. Anyhow, the first respondent is directed to complete the investigation 2/4

and to file a final report in Crime No.108 of 2022 within a period of three months from the date of receipt of a copy of this order.

4. With the above direction, this Criminal Original Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. 08.02.2023 NCC :
