Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the respondent to conduct a fair investigation and to file a final report in Crime No.51 of 2024 on the file of the 2nd respondent Police as contemplated under Section 173 of BNSS, 2023 within a stipulated time fixed by this Court.

ORDER

The petitioner, with a grievance that the case in Crime No.51 of 2024 which has been registered on 23.03.2024 has not been enquired by the 1/4

respondent Police has filed this petition seeking a direction to the respondent Police to conclude the investigation in Crime No.51 of 2024 within a stipulated time.

2. When this petition is taken up for hearing, the learned Government Advocate (Crl. Side) submits that originally, the case was registered as against six accused. During the investigation, they found that three more accused have also involved in this case. Now, they have concluded the investigation, however, they are yet to file the final report. He further submits that the final report would be filed in one or two days.

3. Recording the submissions of the learned Government Advocate (Crl. Side), this Criminal Original Petition is closed. Mere filing of the final report is not sufficient. The respondent Police should ensure that the final report is taken on file, without any delay.
