Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.191/2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 147, 294(b), 323 and 506(i) of I.P.C., in Crime No. 191 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that over a money dispute on 22.05.2023 at about 8.30 p.m., the accused persons called the defacto complainant for negotiation. Therefore, at about 09.00 p.m., when the defacto complainant met the accused 1/3

persons, they unlawfully assembled, abused the defacto complainant in filthy language and assaulted him with hand and made life threat against him. Hence, the complaint.

3.Earlier application filed by the petitioner seeking anticipatory bail was dismissed by this Court on the ground that the petitioner is having bad antecedents. 4.Now this petition has been filed by the petitioner stating that any stringent condition may be imposed upon the petitioner. 5.The learned Government Advocate (Crl. Side) would submit that earlier application filed by the petitioner was dismissed by this Court on the ground that the petitioner is having six previous cases. Now there is no change of circumstances. History sheet in H.S.No.271 of 2020 has been opened in respect of this petitioner. 6.In view of the submissions made by the learned Government Advocate (Crl.
