PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. to direct the respondents 1 and 2 to provide adequate police protection to enforce the order dated 29.07.2019 in I.A.No.1 of 2019 in O.S.No. 624 of 2019 passed by the learned Principal Subordinate Judge, Thiruchirappalli.

ORDER

This petition has been filed for issuing a direction to the respondents 1 and 2 to provide adequate police protection to enforce the order, dated 29.07.2019 made in I.A.No.1 of 2019 in O.S.No. 624 of 2019 passed by the learned Principal Subordinate Judge, Thiruchirappalli.

The learned counsel appearing for the petitioner submitted that there is a dispute between the petitioner and the 3rd respondent in respect of construction of house. The petitioner already constructed a house in a Plot ad measuring 2520 Sq. Ft. 1/3

bearing Door No. 33, situated at Ward III, Block 49 Thiruvanaikovil, Kondayampettai Village, Srirangam Taluk, Trichy District. Hence, there was a dispute between the petitioner and the third respondent herein. In this regard, the third respondent as well as petitioner filed the suit before the Civil Court and in the suit filed by petitioner herein interim injunction granted in favour of him in I.A.No. 1 of 2019 in O.S.No. 624 of 2019. On the strength of the injunction order, the petitioner sought for police protection from the 2nd respondent and it is pending.

3. Heard Mr. Dinesh Hari Sudarsan, learned counsel appearing for the petitioner and Mr. K. Suyambulinga Bharathi, learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2.

Considering the facts and circumstances of the case, this Court directs the 2nd respondent to conduct the enquiry on the complaint lodged by the petitioner, after issuing notice to the petitioner as well as the third respondent, and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

5. With the above observations and direction, the Criminal Original Petition stands disposed of.
