... Respondent/Respondent Prayer:- Civil Miscellaneous Appeal has been filed under Section 173 of Motor Vehicles Act against the award, dated 11/06/2010 in MCOP.No.274 of 2007 on the file of the Motor Accident Claims Tribunal (Sub Court), Trichy.

DECREE:- This Civil Miscellaneous Appeal coming for hearing on this day, upon perusing the grounds of Appeal, the order of the Tribunal and the material papers to the Appeal and upon hearing the arguments of Mr.N.Sudhagar Nagaraj, for the Appeallant and of Mr.P.Prabhakaran, Advocate for the respondent, and this court while allowing in part and doth order and decree as follows:-

(1) That the award passed by the the Motor Accident Claims Tribunal (Sub Court),Trichy dated 11/06/2010 in M.C.O.P.No.274 of 2007,be and hereby is modified.

(2) That, the Insurance Company / Respondent herein be and hereby is directed to deposit the modified amount of Rs.95,000/- together with interest at the rate of 7.5% p.a, from the date of petition till the date of deposit, less the amount already deposited,within a period of six weeks from the date of receipt of a copy of this order;

(3) On such deposit, the claimant /Appellant herein be and hereby is permitted to withdraw the entire amount without filing any formal application before the Tribunal.

(4) That there be no order as to cost in this Civil Miscellaneous Appeal.
