For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.454 of 2016 on the file of the Respondent Police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 406 and 420 of I.P.C., in Crime No. 454 of 2016 on the file of the respondent police, seeks anticipatory bail.
3. In this case, the first accused was granted anticipatory bail by this Court in Crl.O.P.(MD)No.20649 of 2016 on condition that he would deposit a sum of Rs.1,00,000/- without prejudice to his defence in the criminal case.
4. The petitioner's counsel states that from the first accused, a sum of Rs.60,000/- alone came to her account. She is also willing https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.12602 of 2019 to deposit a sum of Rs.75,000/- without prejudice to her defence in the criminal case. Hence, anticipatory bail is granted subjected to this condition.
5. Accordingly, petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate No.I, Kuzhithurai, and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
