Prayer:This petition is filed under Section 151 of C.P.C., praying to permit the petitioner to withdraw the award amount deposited by the 1st Respondent to the credit of the Special District Court to deal with MCOP Cases, Trichy in M.C.O.P.No.755/2022 and thus render justice.

ORDER

(Order of the Court was made by the Hon'ble A.D.JAGADISH CHANDIRA J.) This petition is filed to permit the petitioner to withdraw the award amount deposited by the 1st Respondent to the credit of the Special District Court to deal with MCOP Cases, Trichy in M.C.O.P.No.755/2022 2.Heard.

3.The petitioners / claimants 1 to 3, 5 and 6 are entitled to withdraw 50% of their shares of the deposited amount with proportionate interest. Accordingly, the petitioners 1 to , 5 and 6 are permitted to withdraw their share as apportioned by the Tribunal. Since the fourth petitioner is the minor, in respect of his share in the deposited amount, the same shall be deposited in any one of the nationalized bank in a fixed deposit, initially for a period of three years and renewable thereafter, till she attains majority. The first respondent/Mother, who is the natural guardian of the minor claimant is permitted to withdraw the accrued interest, once in three months directly from the bank and utilize the same for their welfare. 2/3

4.Accordingly, this petition is allowed.
