PRAYER:- For Anticipatory Bail in Crime No.768 of 2023 on the file of the Respondent Police.
ORDER: The Court made the following order:- The petitioner, who is arrayed as sole accused apprehends arrest at the hands of the respondent police for the offences punishable under sections 294(b), 336, 506 (ii) IPC and section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002, 1/5
in Crime No.768 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the de-facto complainant lodged a complaint stating that her husband is working as Junior Assistant in Trichy Corporation. One Vanitha, who is the co-worker of her husband is a widow. She developed some intimacy with one Manikandan, who is the accused herein. Both Vanitha and Manikandan joined together and demanded money from the de-facto complainant and her husband. On 31/07/2022, her husband was assaulted by Manikandan and others. He was taken to the Trichy Government Hospital. Over which, a case in Crime No.583 of 2022 was registered. Thereafter, they vacated the house and now living in her husband's house. On 05/09/2022, the accused came to her house, abused her in filthy language, caused assault.
Over which, a case in Crime No.1288 of 2022 was registered. The accused was arrested and remanded to judicial custody. Again, on 01/05/2023, the petitioner namely the accused herein after coming out of bail, forcibly entered into her house, criminally intimidated with aruval. On the basis of the above said occurrence, the present case has been registered in Crime No.768 of 2023 for the offences stated above. 3.Seeking anticipatory bail, this petition has been filed by the petitioner stating that previous cases have been registered only because of the marital issue and also filed tabulation showing the particulars of the complaint, crime number, etc.
tabulation, he has mentioned that his divorced wife namely M.Ananthi filed criminal cases. Based upon which, a case in Crime No.40 of 2023 was registered on the file of All Woman Police Station, Tallakulam, Madurai; and a case in Crime No.268 of 2016 on the file of the Sellur Police Station, L & O, Sellur, Madurai; Another complaint was given by K.Mohankumar, which according to the petitioner, is his mother-in-law's husband. According to him, there was illicit relationship between the mother of Ananthi and the above said K.Mohankumar. Similarly, another case in Crime No.118 of 2022 was registered on the basis of the complaint given by Vanitha. Another case in Crime No.
583 of 2022 was registered on the file of the Sessions Court Police Station, Trichy on the basis of the complaint given by Prabhu, which according to the petitioner, is having illicit relationship with Vanitha. The above said Vanitha, according to the petitioner, was in love with him and living in together relationship and another complaint given by one Nandhini, who is the wife of the above said Prabhu. So according to the petitioner, Prabhu is having extra marital affair with Vanitha. In Crime No.674 of 2011, he was acquitted. According to the petitioner, because of the issue, which was created by his divorced wife, series complaints have been registered. So far as this complaint is concerned, the very same Nandhini, who is the complainant in Crime No.1288 of 2022 has foisted this complaint.

4.It appears that all is not well within the petitioner because of some personal issue, several persons are continuously involved in repeated commission of crime. In all these cases, the petitioner has been implicated. 5.Considering the antecedents of the petitioner and also his conduct, this court is not inclined to grant anticipatory bail to the petitioner. There is no meaning in granting anticipatory bail to a person like this petitioner, who repeatedly involves in continuous offence one after another.
