This petition has been filed seeking transfer of investigation in Crime No.400 of 2021 from the file of the third respondent to the file of the fourth respondent and consequently direct the fourth respondent to conduct proper investigation in an expeditious manner and to file the final report within the stipulated period as prescribed by this Court.

2.A case has been registered on the basis of the complaint given by the petitioner in Crime No.400 of 2021 for the offences punishable under Sections 294(b), 323 and 506(i) of IPC on 01.10.2021.

3.The learned Additional Public Prosecutor submitted that merely 30 days only over and without even waiting for completion of preliminary state of enquiry, the petitioner has come forward with the present petition without proper reasons.

4.The learned counsel for the petitioner submitted that two of the named accused persons are about to go to abroad and the respondent police is not interested to prevent them. 5.But however, since it is a simple issue and the accused persons are about to go to abroad, the third respondent is directed to complete the investigation in this case and file final report before the concerned Court, within a period of one month from the date of receipt of a copy of this order and after filing the final report compliance report must be submitted to the Registry. 6.With the above directions, this Criminal Original Petition is disposed of.
