PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondent to expedite the proceedings in Na.Ka.No. Aa/2/6477/2020 dated 15.12.2021 on the file of the respondent within a period stipulated by this Court.

The petitioner has filed this writ petition for a Mandamus, directing the first respondent to expedite and conclude 1/5

the proceedings in Na.Ka.No. Aa/2/6477/2020 dated 15.12.2021, which is pertaining to the application filed by the petitioner, sought for a death certificate of his father one Mari, who died on 25.01.2000.

2.The learned counsel appearing for the petitioner submits that as per the directions of the respondents, the petitioner has paid the necessary fee of Rs.500/- and also made a paper publication in 'Makkal Kural' on 03.01.2021 and complied with all other formalities. Even thereafter, the death certificate has not been issued by the respondents, due to which, the petitioner is facing several difficulties.

3.Mr.M.Sarangan, learned Additional Government Pleader, who takes notice for the respondent on instructions submits that the petitioner has approached the Revenue Divisional Officer as if no death certificate has been issued for the death of the petitioner's father, namely, Mari. The petitioner is the son of the third wife of the 2/5

said Mari and at the instance of the first wife of Mari, the death certificate has already been issued on 22.08.2012. However, the petitioner has filed the application in the year 2021 as if the death certificate has not been registered. He further submits that the petitioner has not appeared before the respondent after filing of application. In view of above, the respondent has not passed any further order in his application.

4.Considering the submissions made by the learned Additional Government Pleader, this writ petition is disposed of with a direction to the petitioner to appear before the respondent on 09.10.2023 at 11.00 a.m. The respondent shall pass final orders on his application within a period of one week from thereon. No costs. 26.07.2023 NCC : Yes / No.
