PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents 1 to 3 to consider the petitioner's representation dated 04.08.2023 with respect to his request for the cancellation of the certificates dated 11.05.2022 and 12.01.2016 issued by the fourth respondent with regard to the registry, possession and enjoyment of the land in S.No.66/1 of Moopunpatti hamlet of Kovilpatti Town and Taluk in Thoothukudi District.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider the petitioner's representation dated 04.08.2023 with respect to his request for the cancellation of the certificates dated 11.05.2022 and 12.01.2016 issued by the fourth respondent with regard to the registry, possession and enjoyment of the land in S.No.66/1 of Moopunpatti hamlet of Kovilpatti Town and Taluk in Thoothukudi District.

2. The brief facts are that the fifth respondent's husband, namely Late Sankaran @ Sankarasubbu, sold the property to the petitioner. However, there was 2/5

an attachment by the revenue authorities under the Revenue Recovery Act for excess dues. The petitioner purchased the property after payment of the revenue dues to the revenue authorities, thereby perfecting his title. Subsequently, he also mutated the revenue records, and the patta stands in his name after payment of the revenue dues. The fifth respondent submitted an application before the fourth respondent for a possession certificate and for issuance of kist receipts. The Village Administrative Officer issued both certificates. Now, the petitioner is seeking to cancel the same.

3. Pending the writ petition, respondents 5 and 6 preferred a suit in O.S.No.392 of 2022 on the file of the Sub Court, Kovilpatti. The petitioner is arrayed as a defendant in the said suit. The suit has been filed for declaration, injunction, and cancellation of the sale deed executed in favour of the petitioner.

4. Since the issue between the parties ought to be decided in the suit, this Court is not inclined to pass any orders. However, it is a settled proposition that possession certificates, kist receipts, and revenue documents will not determine title. The Trial Court shall consider the suit independently, uninfluenced by the orders passed by the revenue authorities, by considering the independent evidence and pass appropriate orders in accordance with law. 3/5

5. Accordingly, this Writ Petition is closed. There shall be no order as to costs.
