ORDER
This petition has been filed seeking direction to the third respondent not to harass the petitioner with a malicious intention of initiating a false criminal proceedings and slamming false cases against the petitioner.
2.The learned counsel for the petitioner submitted that he was falsely implicated in a previous case in Crime No.2 of 2017 on the file of the third respondent herein and that was quashed by this Court in Crl.O.P.(MD).No.2388 of 2017, by the order dated 05.04.2017 and thereafter, no case was registered or pending against this petitioner. But however, the respondent police frequently giving trouble to the petitioner even during the odd hours. 3.The learned Additional Public Prosecutor submitted that the petitioner was facing two enquiries under Section 110 Cr.P.C. Crl.O.P.(MD)No.16306 of 2021 previous occasion in 13.08.2018 and 01.11.2016. Only for the purpose of making surveillance and enquiry visit was made and except that there is no harassment was made to the petitioner. Even though it has been stated that it is for the purpose of making surveillance, it may not be proper on the part of the respondent police to visit the petitioner's house at the night hours and knocking the door of the petitioner and the same may done without making any trouble or nuisance during the day hours.
4.With the above said directions, this criminal original petition is disposed of.
