2. By the impugned order dated 16.03.2021 bearing Reference No.34254/A3/2019, the first respondent has rejected the request of the petitioner to renew for the permit and fitness certificate of bearing Registration Nos.TN 65Y 9516 and TN 65Y 0526 respectively.

3. Operative portion of the impugned order reads as under:-

2. Regarding Renewal of Permit application for Stage Carriage - Spare bus, TN 65Y 0526, application was 7/18

received on 20.02.2020 and was signed by one, Thiru.M.Mohamed Jamil. The issue being, it was not signed by the Permit holder, Tmt.S.K.A.Noorjahan Beevi. Whereas, Tmt.S.K.A.Noorjahan Beevi, the Original Permit holder, vide her representation dated 15.04.2019 and 29.04.2019 have already informed, not to entertain any application for the renewal of fitness certificate from anybody in person or through online. She has further requested, to entertain renewal of fitness certificate, only after obtaining her signature in person in the Application Form.

In this regard, relevant provision stated in Rule 193 of Tamil Nadu Motor Vehicle Rules, 1989 is reproduced as below:- ' Application for the renewal of permit shall be made in the Form PRA to the Transport Authority by which the permit was issued . The application shall be accompanied by the fees prescribed in the Table under Rule 279. If the registered owner of the vehicle has entered into an agreement of hire purchase, hypothecation or lease, the application for renewal of permit should be accompanied by the documents specified under sub-section (8) of section 81'.

Thus form the above rule provision, it is inferred that the registered owner of the vehicle alone can make application in PRA form, for getting the permit of their vehicle renewed. As such in this instant case, the registered owner of Stage Carriage - Buses, TN 65Y 0526 and TN 65Y 9516, as per this Office's record is Tmt.S.K.A.Noorjahan Beevi.

In these circumstances, it is informed that as per the prevailing rules, applications for renewal/fitness certificate relating to Stage Carriage- Buses, TN 65Y 0526 and TN 65Y 9516 can be taken up for consideration, only if it is received from Tmt.S.K.A.Noorjahan Beevi*, the Registered owner of these vehicles, in due Form along with Original records and applicable Fees. (*The petitioner in other three writ petition). 8/18

Prayer 8402/2018 Writ petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the respondents 1 and 2 to return the original records of the stage carriage permit on the route Paramakudi to Thirupattur, the renewal of permit to the petitioner with the original of the Certificate of Registration of vehicle bearing Registration No.TN 65 Y 9516 after making necessary endorsements of renewal as per the Rule 196 of the Tamilnadu Motor Vehicles Rules.

19304/2019 Writ petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the respondents 2 and 3 to cancel the fitness certificate granted to the petitioners stage carriage bearing Registration No.TN 65 Y 9516 and the spare bus bearing Registration No.TN 65 Y 0526 with reference to the representation of the petitioner dated 15.4.2019 and 26.4.2019 to the respondents 4 and 5.

466/2022 Writ petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the 1st and 2nd Respondents to pass an order on my application dated 08.11.2021 to grant replacement in respect the vehicle bearing Registration No. TN 51 AA 4017 instead of TN 65Y 9516 plying on the route Paramakudi to Thiruppathur

5. For the sake of convenience, the petitioner in Table - I 9/18

shall be referred to as the petitioner and the petitioner in TableII shall be referred to as the respondent.

6. The petitioner and respondent belong to the same family. The Petitioner is the son of the respondent. The dispute in these writ petitions relates to renewal of stage permit in respect of the Bus bearing Registration No.TN.65Y-9516 and Spare Bus permit bearing Registration No.TN.65Y 0526 and renewal of Fitness Certificates thereof.

7. Admittedly, the permits, fitness certificate and the registration certificate of the respective vehicles are in the name of the respondent.

8. It is the case of the petitioner that the respective stage carriers and the permits were purchased /procured from the previous owner in the name of the respondent out of love and affection by the petitioner along with his younger brother Mohammed Thowbieck.

9. On the other hand, it is the case of the respondent that the petitioner along with his younger brother, Mohamed Thowbieck were only allowed to manage the business due to her age and health condition and that the vehicles along with the permit were purchased out of her hard earned savings.

10. In this connection, the petitioner and his younger brother have filed O.S.No.109 of 2013 before the District Munsif Court, Paramakudi against the respondent-mother for declaration. It appears that the suit was originally filed for a permanent injunction to restrain the respondent from interfering with the day to day affairs of the business of the petitioner along with his younger brother Mohamed Thowbieck.

11. I.A.No.794 of 2013 in O.S.No.109 of 2013 was filed to restrain the respondent from interfering with the affairs of the business. The District Munsif Court ordered Status-quo on 10.03.2015. The proceedings are said to be still pending as on date. The trial has said to have commenced.

12. During the interregnum, the renewal of the permit and fitness certificate for the respective stage carriage bus and spare bus bearing Reg.Nos.TN 65Y 9516 & TN 65Y 0526 came up. 10/18

13. The stage carriage permit in respect of spare bus was not renewed for the period between 10.03.2015 and 11.03.2020. It appears that all along the original of the permit and the Fitness Certificate together with registration certificate and insurance policy have been in possession of the petitioner.

14. The petitioner had filed application in the name of the respondent for renewal of the permit for the bus bearing Registration No.TN.65 Y-9516 which was renewed by order dated 2.1.2018 of the second respondent Secretary, Regional Transport Authority. This renewal was questioned by the respondent.

15. However, the 3rd respondent failed to implement order dated 2.1.2018 of the second respondent, the petitioner filed W.P.(MD) No.6012 of 2018.

16. An interim order came to be passed by this Court on 21.03.2018 in W.P.(MD)No.6012 of 2018 by restraining the respondent from revoking the renewal of permit vide proceedings of the second respondent in ROC.No.4098/83/2017/2-2018.

17. Parallelly, the respondent filed W.P.No.8402 of 2018. In the said writ petition, the official respondents have confirmed that the original documents were returned back to the petitioner after the order dated 02.01.2018 was passed by the 2nd respondent Regional Transport Authority renewing the permit for the stage carrier bearing Reg.No.TN.65-Y 9516. Since, the documents are not with the official respondents, W.P.No.8402 of 2018 filed by the respondent, is liable to be dismissed as infructuous.

18. Rest of the three writ petitions filed by the petitioner in Table-I deal with the renewal of the permit and Fitness Certificate for the respective stage carriage bus and spare bus bearing Registration Nos.TN 65 Y 9516 and TN 65 Y 0526.

19. Learned counsel for the petitioner submits that the second writ petition filed by the respondent in W.P.No.1930 of 2019 to cancel the Fitness Certificate granted to the petitioner's stage carriage bearing Registration Nos.TN 65Y 9516 & TN 65Y 0526 which is the subject matter of W.P.No.19304 of 2019 has been rendered infructuous in the light of the dated 21.03.2018 in W.P.(MD)No.6012 of 2018.

20. It is further submitted that W.P.No.19304 of 2019 filed by the respondent is also liable to be dismissed as infructuous. 11/18

21. I have heard the learned counsel for the petitioner and the learned Additional Government Pleader for R1 to R3 and the learned counsel for R4. The point that arises for consideration in these writ petitions is whether the petitioner is entitled to the relief in the writ petitions in Table-I or whether the respondent is entitled to the relief in Writ Petitions filed by her as in Table -II.

22. The facts on record clearly establishes that the respondent is the legal and dejure owner of the stage carriage bearing Registration No.TN 65Y-9516 and TN.65Y-0526. There is no dispute that the business was being and is managed by the petitioner along with his younger brother viz., Mohamed Thowbieck .

23. Section 81 of the Motor Vehicle Act, 1988 r/w Rule 195 of the Tamil Nadu Motor Vehicle Rules,1989 deals with provisions relating to renewal of permits. They read as under:- Section 81 of the Motor Vehicles Act, 1988 Rule 195 of the Tamil Nadu Motor Vehicles Rules, 1989 Duration and Renewal of Permits.- Permit-renewal of endorsement or extension.-

(1) A permit other than a temporary permit issued under section 87 or a special permit issued under subsection (8) of section 88 shall be effective [from the date of issuance or renewal thereof] for a period of five years:

Application for the renewal of an endorsement or extension of validity of a permit shall be made in Form PRA with necessary alterations together with Form PEA, to the Transport Authority concerned within the period specified in sub-section

(2) of section 81 in regard to the renewal of the permit and shall be accompanied by the fee prescribed in rule 279 and permit.

Provided that where the permit is countersigned under sub-section (1) of section 88, such countersignature shall remain effective without Duration and Renewal of Permits.-

(1) A permit other than a temporary permit issued under section 87 or a special permit issued under subsection (8) of section 88 shall be effective [from the date of issuance or renewal thereof] for a period of five years:

Section 81 of the Motor Vehicles Act, 1988 Rule 195 of the Tamil Nadu Motor Vehicles Rules, 1989 Provided that where the permit is countersigned under sub-section (1) of section 88, such countersignature shall remain effective without renewal for such period so as to synchronise with the validity of the primary permit.

(2) A permit may be renewed on an application made not less than fifteen days before the date of its expiry.

(3) Notwithstanding anything contained in sub-section (2), the Regional Transport Authority or the State Transport Authority, as the case may be, may entertain an application for the renewal of a permit after the last date specified in that sub-section if it is satisfied that the applicant was prevented by good and sufficient cause from making an application within the time specified.

(4) The Regional Transport Authority or the State Transport Authority, as the case may be, may reject an application for the renewal of a permit on one or more of the following grounds, namely:- (a) the financial condition of the applicant as evidenced by insolvency, or decrees for payment of debts remaining unsatisfied for a period of thirty days, prior to the date of consideration of the application;

Section 81 of the Motor Vehicles Act, 1988 Rule 195 of the Tamil Nadu Motor Vehicles Rules, 1989 (b) the applicant had been punished twice or more for any of the following offences within twelve months reckoned from fifteen days prior to the date of consideration of the application committed as a result of the operation of a stage carriage service by the applicant, namely:- (i) plying any vehicle-

(1) without payment of tax due on such vehicle;

(2) without payment of tax during the grace period allowed for payment of such tax and then stop the plying of such vehicle;

(3) on any unauthorised route;

(ii) making unauthorised trips:

Provided that in computing the number of punishments for the purpose of clause (b), any punishment stayed by the order of an appellate authority shall not be taken into account:

Provided further that no application under this subsection shall be rejected unless an opportunity of being heard is given to the applicant.

Where a permit has been renewed under this section after the expiry of the period thereof, such renewal shall have effect from the date of such expiry irrespective of whether or not a temporary permit has been granted under clause (d) of section 87, and where a temporary permit has been granted, the fee paid in respect of such temporary permit shall be refunded.

Permit-renewal of endorsement or extension.- Application for the renewal of an endorsement or extension of validity of a permit shall be made in Form PRA with necessary alterations together with Form PEA, to the Transport Authority concerned within the period specified in sub-section

(2) of section 81 in regard to the renewal of the permit and shall be accompanied by the fee prescribed in rule 279 and permit.

24. As per Section 81 of the Act, a permit may be renewed on an application made not less than 15 days before the date of its expiry. It has to be filed by applicant.

25. The expression "applicant' has not been defined either in the Motor Vehicles Act, 1988 or in the Tamil Nadu Motor Vehicle Rules, 1989. The Central Motor Vehicles Rules 1989 also is silent though the expression is used in the context of application for grant of licence, permit etc under the Act and Rules.

26. The expression "applicant" can only mean the person in whose name, the registration certificate has been issued and not the person who may have actual possession of the vehicle or original copy of the permit, FC, Registration Certificate Book etc. unless authorised by the person who is the legal owner.

27. Otherwise, anybody other than owner can file an application and hijack the business of such owner. Therefore, the petitioner cannot claim right do the business in absence of valid transfer of permit of the respective vehicle to his name by the respondent.

28. As long as the registration of vehicles and the permit stand in the name of the respondent, the renewal of the permit and 15/18

the Fitness Certificate can be given only at the behest of the respondent. It cannot be at the behest of the petitioner. The fact that the petitioner may be in possession of the documents owing to his relationship with the respondent is of no relevance.

29. Application in the name of the respondent for renewal of permit or fitness certificate cannot be made by the petitioner notwithstanding the fact that the petitioner is in possession of the original documents and had paid charges/fees for such renewal.

30. As far as the statutory renewal of permit and fitness certificate is concerned, the official respondents cannot be forced to grant such renewal in the name of the respondent at the behest of the petitioner, if the petitioner has not authorised by the respondent to apply for such renewal.

31. In my view, the official respondents Regional Transport Authority has rightly rejected the request of the petitioners in their communication dated 16.03.2021 bearing Reference Nos.34254/A3/2019 in Table II in Sl.Nos.2 to 4. Therefore, all the writ petitions filed by the petitioner are liable to be dismissed.

32. The relief in W.P.No.466 of 2022 filed by the respondent is concerned, also cannot be granted by directing the first and second respondents to pass an order of the application dated 8.11.2021 of the petitioner to grant replacement in respect of vehicle bearing Registration No.TN.51AA 4017 instead of TN 65Y 9516 plying on the route Paramakudi to Thiruppathur.

33. The respondent will be entitled to such renewals only subject to the respondent satisfying the requirements of the Motor Vehicle Act, 1988 and Rules made thereunder as per Section 81 of the Motor Vehicles Act, 1988.

34. Since admittedly the original documents are still in possession of the petitioner and since the Civil Court is seized of the issue, the relief cannot be granted in W.P.No.466 of 2022 to the petitioner at this stage.

35. The respondents may pass appropriate orders on merits on the petitioner's representation dated 8.11.2021 subject to final outcome of the suit in O.S.No.109 of 2013.

36. Considering the fact that the suit is of the year 2013, the learned District Munsif, Paramakudi is directed to expedite the final disposal of the suit in O.S.No.109 of 2013 filed by the petitioner and bring a closure of the case by deciding the rights of the respective parties, within a period of six months from the date of receipt of a copy of this order.

37. All future renewal will be subject to the final outcome of the proceeding in O.S.No.109 of 2013 pending before the learned District Munsif, Paramakudi.

38. Only option for the petitioner and the respondent at this stage is to enter into a compromise to save the business and the permits and the fitness certificate from getting lapsed as and when the next renewal falls due.

39. In the result, W.P.Nos.8402 of 2018 and 19304 of 2019 filed by the respondent are dismissed as infructuous. W.P.Nos.6012 of 2018, W.P.Nos.8137, 8145 and 7489 of 2021 filed by the petitioner are dismissed.

40. W.P.No.466 of 2022 stands disposed in terms of the above observation. No costs. Consequently, connected miscellaneous petitions are closed.
