PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the Respondents 1 and 2 to provide the police protection to the Petitioners wife and school going children, on the basis of the Petitioners representation dated 22.08.2019 For Petitioner : Mr.A.Rajini For Respondents : Mr.K.Suyambulinga Bharathi No.1 and 2 Government Advocate(Crl.Side)

ORDER

This petition has been filed seeking direction to direct the first and second respondents to provide the police protection to the Petitioners wife and school going children, on the basis of the Petitioners representation dated 22.08.2019.

2. The learned Government Advocate(Crl.Side) would submit that the husband of the petitioner already committed offence and the same has been registered in Crime No.1194 of 2019 for the offences under Sections 294(b), 406,420 and 506(ii) of IPC and only to escape from the clutches of law, the present petition has been filed seeking police protection and there is absolutely no threat to the wife and children of the petitioner. Therefore he vehemently opposed to grant police protection to the petitioner and her children.

3. It is seen that the petitioner's husband had committed offence and the same has been registered in Crime No.1194 of 2019 for the offences under Sections 294(b), 406,420 and 506(ii) of IPC. It is also seen that the defacto complainant lodged complaint for misappropriation of funds as against the husband of the petitioner. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. Considering the facts and circumstances of the case police protection cannot be granted now. However the respondent police is directed to ensure that the defacto complainant should not visit the petitioner's house frequently.

5. With the above direction the Criminal Original Petition stands disposed of.
