ORDER
The petitioner herein seeks a direction to the first respondent to dispose of the appeal filed by the petitioner on 19.04.2025 under Section 12 of the Patta Pass Book Act, 1983, within the time stipulated by this Court.
2.Heard the arguments of Mr.M.Paramasivam, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader appearing for the respondents 1 and 2. Since no adverse order is passed against the respondents 3 and 4, notice to them is dispensed with.
3.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
4.The petitioner herein filed an appeal before the first respondent challenging the issuance of separate patta in favour of the third
respondent pertains to the property situated in Survey No. 37/5A1. The appeal by the petitioner was filed on 19.04.2025 and the same has not been taken up for consideration till date. Hence, the petitioner has come before this Court.
5.The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the appeal preferred by the petitioner will be considered on its own merits. 6.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the appeal preferred by the petitioner dated 19.04.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the respondents 3 and 4. Accordingly, this Writ Petition is disposed of. No costs.
