Mechanical Engineering in the 2nd respondent college in the light of G.O.Ms.No.85, Higher Education Department, dated 16.04.2010 within a time.

ORDER
This writ petition has been filed seeking a direction to the respondents to refund the tuition fee of Rs.16,000/- to the petitioner, being a first graduate, for completion of B.E. Mechanical Engineering in the 2nd respondent college, in the light of G.O.Ms.No.85, Higher Education Department, dated 16.04.2010, within a stipulated time.
2. Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.
3. According to the petitioner, he was allotted a seat to study B.E. Mechanical Engineering in the second respondent institution during the academic year 2016-2020 through the single window counselling conducted by the first respondent, and he was accordingly admitted to the second respondent institution. At the time of counselling, the respondents directed the petitioner to pay the college fees, including tuition fees, with an assurance that the tuition fee would be refunded in due course. Accordingly, the petitioner paid the college fees, including tuition fees, to the second respondent.
4. It is further submitted that, as per G.O.Ms.No.85, Higher Education 2/5
Department, dated 16.04.2010, a first graduate candidate selected through single window counselling conducted by the Government is eligible for tuition fee concession. Hence, the petitioner made a representation to the respondents seeking refund of the tuition fees paid by him. Since no action was taken, he has filed the present writ petition.
5. The learned counsel for the respondents submitted that, upon receipt of the request letter in the proper format, the respondent/University is ready to refund the said sum.
6. In view of the above, the petitioner is directed to submit a request letter in the prescribed format. On receipt of the same, the respondents shall consider it and pass appropriate orders within a period of three months. 7.Accordingly, this writ petition is disposed of.
