ORDER

This petition is filed seeking direction to the 3rd respondent herein not to harass the petitioner under the guise of enquiry, without any proper complaint or enquiry.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents would submit that no enquiry or complaint is pending against the petitioner. However, as per the circular that has been issued by the Director General of Police, Tamil Nadu, surveillance has been undertaking with regard to the movement of the petitioner. Except that, there was no harassment.

3.However, the photographs, which have been enclosed in the typed set of papers, show that the police visited the residence of the petitioner during night hours and they enquired the petitioner. 4.Now, the grievance of the petitioner is that he is having wife as well as small child and the visit of the police officials is causing much inconvenience to him as well as to his child. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.16458 of 2021 5.No doubt, History Sheet has been opened against the petitioner. In such event, without any proper complaint, it may not be proper on the part of the respondents herein to make a visit during night hours. No doubt, the petitioner is alleged to have involved in Crime Nos.138 and 162 of 2016, that has been quashed. 6.With the aforesaid observation, this petition stands disposed of with liberty to the petitioner to approach this Court for appropriate remedy, if any trouble arises or exists in future.
