PRAYER :-For Bail in Crime No.259 of 2010 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 25.07.2022, in pursuant to the execution of NBW issued by the learned Assistant Sessions Judge, Eraniel, in S.C.No.23 of 2012, concerned in Crime No.259 of 2010 on the file of the respondent police, for the alleged offence under Sections 450, 394, 398 r/w Section 34 of IPC, seeks bail.
2.The petitioner was arrested and remanded on 25.07.2022, on execution of warrant, which was issued on 12.02.2019. In SC No.23 of 2012, this petitioner is arrayed as 2nd accused. 3.The learned counsel for the petitioner submitted that the petitioner is a labour and due to his job nature, he went to Kerala and could not attend the Court. Further more, he was also not aware of the warrant issued against him.

CRL OP(MD). No.15614 of 2022 4.The contention raised by the learned counsel for the petitioner that the petitioner is not aware of the warrant pending against him and he went to Kerala, only for his job. Such kind of contentions are not acceptable at this stage, since trial has been commenced, in this case. The petitioner ought to have made arrangements for his absence, ie., representing through his Counsel. 5.Hence, at this stage, this Court is not inclined to enlarge the petitioner on bail. The petitioner can revive his bail petition after the completion of examination of material witnesses are over. 6.Accordingly, this Criminal Original Petition stands dismissed.
