PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the first respondent to comply with the order passed by the Judicial Magistrate No.V, Madurai in Cr.M.P.No.1232 of 2023, dated 17.04.2023 and consequently direct the first respondent to register a FIR on the complaint of the petitioner dated 10.01.2023. O R D E R

This Criminal Original Petition is filed seeking for a direction to the first respondent police to comply with the direction of the learned Magistrate, dated 17.04.2023 passed in Cr.M.P.No.1232 of 2023.

2. It is submitted by the learned counsel for the petitioner that he has filed a complaint before the learned Magistrate under Section 200 Cr.P.C., and the same was referred to the respondent police under Section 156(3) Cr.P.C., and direction was given to the first respondent police to complete the enquiry within 30 days and to file a report. It is submitted that even after a lapse of 30 days, report has not been filed, therefore, sought for suitable direction.

3. The learned Government Advocate (Crl.side) appearing for the first respondent submitted that soon after receipt of the complaint from the Magistrate in Cr.M.P.No.1232 of 2023, enquiry was initiated and report was ultimately filed before the Court on 17.05.2023 i.e., within one month as directed by the Magistrate.

4. Since the police stated to have been completed the investigation within one month, no further order needs to be passed. The learned Government Advocate (Crl.side) has also generously handed over the copy of the report to the learned counsel on record of the petitioner.
